Sharing of Information

Our futuristic approach to providing cover works because we value transparency and rely on your trust. It is vital for Hoot to share plan and claims information to ensure fair assessment for providing for risk purposes and to mitigate the number of fraudulent claims.

By accepting Hoot’s terms, you relinquish any right to privacy relating to the information provided and allow for this information to be shared with any other insurance company and the South African Insurance Crime Bureau. This permission will survive the termination of this plan.

Your Personal Information collected by Hoot, and/or its affiliated third parties, may be used for the following reasons:

i. to establish and verify your identity in terms of the Applicable Laws;
ii. to enable Hoot to fulfil its obligations in terms of the Agreement;
iii. to enable Hoot to take the necessary measures to prevent any suspicious or fraudulent activity in terms of the Applicable Laws;
iv. reporting to the Financial Intelligence Centre, Financial Sector Conduct Authority and/or the Prudential Authority in terms of the Applicable Laws;
v. at the claims stage and in order to investigate a claim, obtain information from the South African Police Services (SAPS);

Monthly Plans

Your Policy is payable as a monthly payment via agreed debit order against your bank account or card details. Payment is due on the agreed day of each month, in advance. Please make sure that contact and banking details are kept up to date through the Hoot TM self-service platform and that there are sufficient funds in your account. Hoot TM reserves the right to increase the monthly premium once a year by giving you 60 days’ notice by email to the address held on record on the Hoot TM self-service platform. Failure to make payment on the due date will result in the cover under your Policy not being in force. A 15-day grace period will be allowed for payment to be received, starting from the second month of cover. If no payment is received after the grace period, your Policy will be cancelled. Changes in banking details should be made on your Hoot TM self-service platform at least 10 days before the next payment is due.

Electronic Mandate Acceptance:

A Debicheck debit order mandate request will be sent to your banking app. You are required to accept the mandate in order for your bank to allow Hoot to collect your monthly premium from your bank account. A Debicheck debit order is a condition of sale on your Hoot policy. If you fail to accept the Debicheck mandate, your policy will continue to collect on a normal debit order. In order to enjoy the benefits of your policy which is claim, you will be asked again to accept the Debicheck Mandate.

A. Authorisation:
I hereby authorise (Innovation Group Distribution) to issue and deliver payment instructions to my banker for collection against my account at my bank on condition that the sum of such payment instructions will not differ from my obligations as agreed to in my Contract.

The individual payment instructions so authorised must be issued and delivered on the date when the obligation in terms of the Agreement is due and the amount of each individual payment instruction may not differ as agreed to in terms of the Agreement.

The payment instructions so authorized will carry the code INNOVFSP with reference SERVICExxxxxx (followed by 6 digits). I agree that the first payment instruction will be issue and delivered on the agreed first payment date and thereafter regularly on the agreed regular debit day of each month.

If, however, the date of the payment instruction falls on a non processing day (weekend or public holiday) I agree that the payment instruction may be debited against my account on the following business day.

Subsequent payment instructions will continue to be delivered in terms of this authority until the obligations in terms of the Agreement have been paid or until this authority is cancelled by me/us by giving you notice in writing of not less than the interval (as indicated in the previous Classification: General clause) and sent by prepaid registered post or delivered to your address indicated above.

B. MANDATE:
I acknowledge that all payment instructions issued by you will be treated by my bank as if the instructions had been issued by me personally.

C. CANCELLATION:
I agree that although this authority and mandate may be cancelled, such cancellation will not cancel the Agreement. I also understand that I cannot reclaim amounts, which have been withdrawn from my account (paid) in terms of this authority and mandate if such amounts were legally owing to Hoot.

D. ASSIGNMENT:
I acknowledge that this authority may be ceded or assigned to a third party if the Agreement is also ceded or assigned to that third party.

E. DATE ADJUSTMENT CLAUSE:
You agree that this deduction date may change and may be aligned to the date you receive your salary or income. This deduction date may also change to the previous business day where the deduction date falls on a non-business day (Saturday, Sunday and/or official public holiday) and you will not be able to dispute this presentment.

Third party cell captive conduct standards disclosure

In terms of the Financial Sector Conduct Authority’s Third Party Cell Captive Conduct Standard it is a requirement to disclose the relationship between the cell owner, Innovation FSP (Pty) Ltd (Innovation), and Guardrisk.

Please note that this Policy is subject to a cell captive relationship between Guardrisk and Innovation, as a result of a shareholder and subscription agreement concluded between Guardrisk and Innovation, whereby Innovation is entitled to share in the profits and losses generated by the insurance business. Guardrisk may distribute dividends, at the sole discretion of its Board of Directors, to Innovation during the existence of this Policy. This will not have an impact on your premium.

Therefore, this Policy is subject to an arrangement whereby Guardrisk shares equity with Innovation through a shareholding arrangement and provides Innovation with a facility through which to write Innovation’s own insurance risks.

The Insurer (Product Supplier)

The Insurer underwrites the benefits of your Policy. Your Policy conforms to the requirements of the Short-Term Insurance Act 53 of 1998 (as amended) and in no way detracts from your legal rights. Guardrisk Insurance Company Limited is a licensed non-life insurer and registered FSP with (FSP Nr 75).7
